The Racketeer Influenced and Corrupt Organizations Act (commonly referred to as RICO Act) can be prosecuted in either state or federal court. The federal law is laid out in 18 U.S.C. §§ 1961-1968, and the state law in Minn. Stat. Sections 609.901-609.912 -- both jurisdictions provide for severe criminal penalties. RICO was first enacted as part of the Organized Crime Control Act of 1970. It was originally intended to be used as a tool for the government to prosecute organized crime, but law enforcement and prosecutors have expanded the use of RICO to investigate and prosecute individuals and businesses far outside of what the law initially contemplated. RICO has been used far beyond mob bosses -- it has been used to search and prosecute financial companies, banks, and a host of other types of businesses.

The person convicted may also have to forfeit all property and business interests associated with the counts they were convicted under.
